Default Jaguar 3.0 V6 auto diesel overrun after servicing

This vehicle was 4 years old with only 25k miles. Following a minor service and being driven back to me by the garage the engine started to burn oil and smoke after being driven just a couple of miles. The car was driven a further 3 miles and went into an overrun and overspeed condition. After braking hard the driver engaged neutral pulled the car off the road and switched off the ignition. the car ran on for 20-30 secs burning oil before stopping. Towed to Jag main dealer (not the garage that did the servicing), investigation showed oil throughout induction system, oil drained from sump and volume in excess of Jag spec. Report Injectors burnt and damaged and DPF red. All six injectors replaced and engine briefly run. Engine knock and engine diagnosed as beyond economic repair. recommended a new engine. Cause of overrun reported as overfilling of the oil at the point of servicing.
Company who were contracted franchised the work to a local garage but dispute the cause and extent of damage vehicle taken to a second garage by them and an independent report commissioned by a automotive expert company. Engine stripped, damage to cylinder heads and lower bearings.
The fuel injectors which had been damaged by the overrun tested by a specialist agency confirmed leakage on 4 injectors one full open and one would not pressurise. They argue overfill was due to injectors overfuelling due to DPF and diluting the oil in the sump causing eventual overrun. if the engine oil was fresh how could just a couple of miles driving cause engine oil dilution and overrun?
Engine was running perfectly before servicing no warning indications and passed the emissions test. Due to delay by the 3rd party carrying out the 2nd examination and report the ECU had been wiped because the battery had been disconnected for a prolonged period so unfortunately no ECU data is available. This matter is still subject to dispute. Seems a no brainer but any thoughts?

Welcome to the forum Stoodee,

Sorry to hear about your engine problems.

As the issue is clearly contentious and still subject to dispute, it will almost inevitably end up in protracted and costly litigation with claim and counter claim.

I wish you luck but the forum is not the place to pre-empt any such action.
