Default Picked up a brand new XF and at 100 miles the car broke down!

I just got out of a 2014 Mazda 6 GT (fully loaded) and bought a leftover 2013 Jaguar XF 2.0T. I financed the car as a new vehicle (had 20 miles on the odometer at the time of purchase). I came from a 2012 Audi S4 that plagued me with issues after getting it tuned and after spending a lot of money out of pocket I decided to go Japanese. I decided after owning the Mazda for around 18 months that I needed another premium brand vehicle and looked at 5 series, A6's and E classes. A friend recommended Jaguar and the second I saw and drove the XF I fell in love. It was a base model with the 2.0 engine. I drive quite a bit for work and like the fact that I haven't gotten a speeding ticket since I got rid of the 400+ horsepower S4 and downgraded to a 4 cylinder so it worked out perfectly. Besides, even though the fuel economy isn't that much better than the supercharged 3.0 the XF offers the deal I got on the car was so fantastic I couldn't turn it down.

I owned the car for about 24 hours until it completely broke down. The odometer read 100 miles and I was getting onto an on ramp to the highway. The car began to buck I lost power steering brakes etc so I pull over. I turn the car off and on. It stays on for literally 10 seconds before the engine cuts power again. Trapped in Park and only having seconds to get it into neutral I called a tow truck and waited (jaguar roadside assistance is absolutely terrible waited an hour and a half and they hadn't located a tow company in the area that would tow me. I called the first tow company I found on my google maps and they got me in ten minutes.)

I brought it to the dealer late Friday afternoon they gave me a loaner to take on vacation. I was supposed to take my brother to the outer Banks in my new car but that had obviously been ruined. They said they will be calling me Monday to give me an update on the issue.

I am not going to have a prejudice towards jaguars reliability due to this instance because its obviously a fluke problem. So the last two days I've been doing heavy research. I called jaguar of america and gave them my VIN. They checked it for recalls and said my car has recall J034. This basically means that the hose clamp is faulty can make it fall off and makes the engine unable to suck in any air making it stall. This was a stop sale recall due to the safety issues and I found the actual recall letter jaguar dealers received and looked into the laws. It says on the letter that any cars affected must be held at the dealer and if they sell any it is against the law and they will receive a civil fine of 7000$ per vehicle if they sell them. The law matches this saying any new cars with safety recalls enforce a stop sale on the vehicles and they cannot be sold until fixed. I am pretty concerned with the fact that Jaguar sold me a vehicle with such a dangerous recall. If I had driven another 10 seconds I could have been killed on the highway. I am not sure where to go from here. This whole experience has been awful and I want to be indemnified for everything that has happened.

What do you guys think I should do? And what do you think they owe me? I'm not looking to sue jaguar or anything, I'm an honest person, but they were extremely negligent in not fixing this problem before selling me this vehicle.

Thanks for reading.. I want my Jag back!

Also, if the problem happens to not be the recall (I doubt this will be the case) I will accept nothing less than another car from Jaguar.

What a terrible experience to start you off on Jaguar ownership!!
I have little experience with dealers (none actually) but it sounds like yours is less than wonderful and one of those who gives car dealers such a bad name.

I'm sure there are legal issues here that I'm certainly not qualified to address, but I can welcome you to the forums.

Welcome from ElinorB.

Thank you,
I'm just wondering how I should handle this when they call me tomorrow. As I said I'm on vacation until Saturday so im going to have to handle this over the phone.

When they call, just collect information from them. Don't mention any of this, just listen to what they have to say and write it down, with date and time. When you get home, you can decide whether or not to seek 1/2 hr advice from a lawyer, or perhaps you'll think of something the dealer can do to make it up to you without involving the authorities. Get that agreement in writing. I understand this is an emotional issue but nothing good will come of being confrontational, whether you or not you intend it.

Good luck, and welcome to the forum. Stick around for a bit.

Never been in a car yard and never will unless I win lotto. Then again I will probably look for a private sale Veyron or original GT40 locally(good luck to me finding one).
New cars are nice but I was put off the whole "New" thing after a new GSX-R750R in 1985,never set foot in a car yard since, except when getting the mother in law sorted with her 03 V6 X-type,and 06 Series 1 bmw,(not my problem).

This is the exact advice my father gave me. I completely agree no reason to ruffle feathers if I may not have to. They were very understanding and felt awful when I showed up with the car after it broke down. This seems to be the way to go.
