Sorry Jason. Thank god he didn't hit somebody. Could you imagine a year from now if you hadn't made the call to the police but just settled with the shop owner, and they came looking for you because this butt hole had killed a kid?

Hope you get this all sorted out.

Talked to my insurance company tonight. They are treating it as a theft and are making arrangements to have my car fixed immediately. And thank god for good insurance companies. While i have had numerous vehicles in the past, this is really the first time i have had to deal with a loss like this. And progressive has been unbelievable. It is in their hands and my insurance will not be affected by this. However the depreciated value will not be recoverable. I just want my car back the way it was.

And motormouth, ill have a pic for you later............. HA HA HA HA

Jason,

Maybe you can file a claim against the detail shop for diminished value. I would also bill them for the diminished value appraisal similar to what Jon89 is doing.

Good luck,

Mike

Jason,

I highly recommend that you pursue a diminished value claim against the insurance company of the detail shop. Call the Auto Appraisal Group in Charlottesville, Virginia to get detailed information that will cover every step you need to take in order to pursue this. I selected them to perform my appraisal for my pursuit of a diminished value claim against Geico, the insurance company of the driver who hit me back in August. They have been wonderful to work with and my decision to involve them in my claim has already proved to me that I will receive the maximum amount for my diminished value claim whether I wind up settling out-of-court or deciding to proceed with taking Geico to court if they will not meet all of my terms....

You can reach the Auto Appraisal Group at (800) 848-2886. Explain your situation and they will put you in touch with one of their local agents in your area. Don't leave this compensation on the table - you deserve every dollar of it and it is your absolute right to claim it and be compensated for your loss....

Just a quick word of advice.... Don't use Progressive's shop unless you know them. Did the whole "Let Progressive Handle It" thing and they ended up paying twice to fix my silver Honda Accord. I very distinctly put on the paper work that only OEM parts were to be used... Make a long story short, my Honda dealer fixed it the second time with the correct OEM bumper and radiator. The Progressive shop had used inferior replacement parts. I had the dealer inspect the car when I got it back. Also, the paint work done by the original shop was crap! It was a comp claim involving a hit and run in a parking lot. After telling me my rate wouldn't go up since it wasn't chargeable they changed their story after I made them fix my car the second time... I now have Allstate. Had to file a claim when Jenn hit a parked car with the PT Cruiser. They took great care of the other person. Then my agent asked if we wanted a body shop referral. I said no. They gave me the claim number and took care of every bill, no problem. I will never go to Progressive or Gieco myself... Others experience my vary......

Good luck in getting her fixed. Also, like other's have said, pursue the additional damages and diminished value with the shop owner. I know it sucks....

One more word (actually quite a few) on getting a professional appraisal.
Years ago when my wife and I married, we had different insurance companys..hers...Mercury, mine...State Farm. I went with hers since the combined was much less money.
Some cellar dwelling actuary pegged my car (86 Olds 442) at $1000. No freakin way...I got it professionally appraised at $8600. Then Mercury wanted their people to do it. They came in at $10900 and that's what was on the policy. The premiun was (IIRC) was only about $100 more a year.
A professional appraisal can be well worth it when it's necessary.

update: heres the list so far:
windshield, front bumper section, panel underneath, fog light, headlight, hood, left front wheel, tire, bracketing for front bumper section, possible other headlight due to cracked mount, driver control arm is cracked.

Right now its 7500.00

Insurance company is going to go after the shop owner and suspect, and also the body shop is suggesting the diminished value clause due to the rarity of the car. They explained it to me today and i didn't even mention it.
