Cost of a new S Type R in 2003 = US$170,000, value now in well kept condition with say 40k miles=US$50,000!
I thought of another part I could use, the wheel well from the passenger side if it's not cracked.

Not dumb but no it's not. Don't even put another 2001 in without planning a dealer to program it (car will refuse to start so towing likely needed).

Do you have the passenger side, rear brake light lenses/housing assembly available from you 03 STR parts car? How much plus shipping? From your pictures, it looks undamaged. Does not have to be perfect. If you will take $100.00 then lets do it. Paypal, check money order, heck for a c note I will send you cash. The STR does not have the chrome bezel around the backup lamp.

I don't know what the part is called but it is the long gray plastic part between the windshield and the dash. Due to all the Florida sun mine is cracked. I'm not sure what color it is in the parts car. Would be interested if it is in one piece and gray.

okay so from what ive read my 2001 s type doesnt have any of those security implications that stop the car from starting. which brings me back to ask the same question in different words. will the 03 dash physically fit in my car all electronics aside?

See, the 03 and up interior changes were mostly a new dash and console..So, to retro-fit you will need both. The mounting points should be the same, I don't see Jaguar being any different than anyone else when it comes to a refresh..
But...The whole electronic layout changed as well. Without getting into paragraphs on this, my advise is to jump on to LXForums.com and read up on what it takes to update an 05 - 07 Chrysler 300 to the refreshed 08 to 10 interior. Many have done it (looks just like new dash pad, console, door panels). It involves all new electronics since they changed the BUS and everything in 08. You will run into the same thing when just trying to change the style of the dash and console. To be honest, if you are going to attempt it, I would get a whole car from a junk yard to have on hand for all the miscellaneous parts you will need.

I'm on the hunt for the refreshed cluster. I spoke with my dealer and they said it's a go. And they will only charge me 0.25 labor to do the reflash. I wonder If the cluster from a x type might work

Don't see why you couldn't. You might need the STR hubs as well.
