The current application form V317 - Application to transfer or retain a vehicle registration number is available for download from:

The Guidance Notes on the form detail the VED (tax) requirements:
As you can see, the tax must not have expired more than 12 months before the transfer application is made.
Depending on how attached you are to the number or its value, taxing could be worthwhile as you will be able to refund the disc at the completion of the transfer and only lose one month.
To tax the vehicle, it must of course have an MoT which could cause you additional problems.

what does the car need for MOT?

floor pannals ,chassis gone, front and rear subframes gone, all in all quoted £2000 just to for welding before any thing that might be found, so not viable, that is far to much. if i had put number plate on retetion in first year of sorn i could have saved plate as explained by local DVLA, but into second year of sorn cannot do, dvla say that is the law and the plate goes back to dvla that to me is legal robbery and yes sick plate cost me a lot money 3 letter 3 number plate

As per Sean I guess.
If the plate is valuable or is to you, why not do the basic repairs to get it through the MOT?
No paint work or anything fancy, simply necessary repairs, and then sort out your plates, followed by flog the car for spares/repair without reg docs.
It will take a little while, cost you some, but you keep the plates, get the tax refunded, and recoup some of the repair cost.
Depends on the value of the Reg.
