Default Handbrake problem

I have refitted the return spring on the handbrake which had been removed by a p.o. it works fine in that it engages and releases ok. Problem is weather it is on or off it slops back onto the micro switch and creates a contact.. Is there some way of setting it so it only hits it when engaged? Is it done by adjusting the cable?

Brinny, that pic is hard to see exactly, but the microswitch might be mounted too low, or the spring plate the end of the spring is mounted to might be mounted incorrectly. The end of the metal part of the lever is meant to hit the M/s lever and activate it.
I do not have a photo of the mechanism as it should be, but maybe someone else does?
