Default TSB's when In Warranty and Out of Warranty

Question reference Jaguar issued TSB's (Technical Service Bulletin).

If Jaguar issued a TSB and the car is currently under a Jaguar warranty, are they (a Jaguar dealer) obligated to make the repair or replacement under the TSB?

If Jaguar issued a TSB and the car is out of the Jaguar warranty, are they (a Jaguar dealer) obligated to make the repair or replacement under the TSB?

Any comments or education concerning these Technical Service Bulletins (TSB) would be greatly appreciated.

I have a list of the TSB's regarding my 2009 XKR with the Date Issued of the TSB, Title and TSB Number. I am just wondering about the obligation that Jaguar might have to the owners, if any; whether in or out of the warranty periods.

TSB's are not "Recalls" so I suspect they hold little weight in warranty unless you are experiencing symptoms identified by the TSB.

There is no legal obligation for a car company to address a TSB except as described above.

Rich, on the forum S/type S/type supercharge, there is a thread that might help explain this matter. Its titled "do you have to pay for TSB work". Put it in their search.

I agree with the others.

View TSBs as 'how-to-fix-it tips', not mandates.

Personally... I think they should immediately fix anything you want... in warranty or out....at NO CHARGE. Why? You are a Jag Man that's why!!!!

If you are friendly the service department, they could cut you a flat rate deal on doing the ones you want to address.

What about a Jaguar "RECALL" if the car is out of warranty?

Will the Jaguar dealer make the repair of replacement parts and labor on a "RECALL"? at no cost to the owner?

Is there a time limit for when a "RECALLED" item (repair/replacement) must be taken care of?

Recalls are a difference kettle of fish. These are safety related only and mandated by the government whether the OEM likes it or not and are always no charge.

No one can force an owner to take a car in for a recall if he doesn't want to take advantage.

And recalls don't have an expiry date - if it hasn't been done on the car, you can get them to do it at any time thereafter. I guess if the parts aren't available any more, that might be an issue, but otherwise, it's a safety issue and they have to sort it out.

Exceptions to the 'no expiration date' are rare, but there have been a few over the years. Not sure if Jaguar has ever had any. I've seen a couple with other manufacturers, though.

For the last several years (and to this day, AFAIK) Jaguar has been unwilling or unable to provide parts for the seat belt recalls on XJSs and XJ40s. Frankly, I mark it down in the 'unwilling' column. Supposedly there's a vendor/supplier problem but I feel certain that if Jaguar was truly concerned I'm sure they could find a way.

I am out of the 4-year warranty on my '10 XKR but, still have CPO warranty. When I took my car in for the ran-down battery and showed them the TSB for a fix, the dealer fixed it without any argument and it cost me nothing.

No doubt that the dealer was reimbursed by the factory, particularly since you're under a CPO warranty. The question is what if you didn't have that warranty?

If you don't have a warranty then it's been stated already that for a TSB you can expect to pay. Do bear in mind that many TSBs are only ever done if the customer is experiencing a problem. (Recalls are not TSBs.) Don't view TSBs as something that necessarily needs doing, you have to read the TSB and decide - if you really want to! Bit of a waste of time to do much more than a quick glance at most TSBs IMO.
