Air Filter Properly Installed?

Had a shop install the Mina air filter, and it looks like this. Car runs fine, nice sound, but since installation I noticed sometimes I have to press the right side of the hood down to get it closed.
Current look:

Then I saw this picture on our Forum, and it seems to be installed on this '04 in a more angled down way.

So I went to the other side of the car and noticed the filter seemed to be above the hood line. I would certianly like to know how the '04's air filter was able to be angled down so much, as mine appears to not be adjustable. I did order the proper 1997-2002 kit, and not the 2003-06 one.

So I took a closer look and found this bracket from the old air box snug against the front side of the current air box. Is that part of the problem? Should it be removed?

My main concern is pressure against the throttle body tube/air mass sensor connections and the filter itself when pushed down with the hood closed. Any ideas on how to correct this? Thanks!

I agree Itspec60, so I took the new box out, and in the pic below I see the old bracket that held the old air filter box. Should it have been removed to make more room?

In this pic, without the box the filter seems in the proper position. So my plan is to remove the old bracket and reinstall the box and see if that resolves the issue.

I see some improvement after taking out the old and new brackets, because I believe the Mina bracket was too tall. The box is down as far as it can go and snug in place but is not screwed into anything, and the filter is lower but still slightly above the hood line. I'll call Mina tomorrow and see what they say. Might be the wrong box.

After I got the box out, I had to go to Lowe's for some tools, so I just put the Mina filter back on the end of the tube and drove away. Car drove/sounded fine, and I doubt the filter moved around at all. I don't think the box does much of anything really, except help marginally with inducting slightly cooler air into the tube from the outside port, but I guess every little bit helps. I'll probably leave it the way it is.
